The law was written in 1860, largely to deal with obscene books and pamphlets. Courts have repeatedly said an object cannot be called obscene just because it is connected to sexual pleasure. In fact, the Calcutta High Court once made the point that if that logic held, even the Kamasutra would have to be banned.
So when someone asks “is ordering sex toys illegal,” the honest, researched answer is: there is no law that makes private personal use illegal. The grey area exists around how things are sold and imported, not around you sitting at home and tapping “buy.”
The Judgment That Actually Protects You
In 2017, a nine judge bench of the Supreme Court delivered something most Indian women have never been told about, despite it directly affecting them. In the Justice K.S. Puttaswamy case, the Court ruled that privacy is a fundamental right under Article 21 of the Constitution. Not a privilege. A fundamental right.

The judges held that personal intimacy, autonomy and sexual choices sit at the very core of human dignity, and that the state has no business interfering in what consenting adults choose to do in private.
